Shipping & Delivery Terms

1. Delivery Terms

 

Unless otherwise agreed in writing, all orders shall be supplied on an Ex Works (EXW) basis from the location specified by the Seller. Any alternative delivery term must be expressly agreed in writing by the Seller.

2. Transfer of Responsibility

 

Where the Seller arranges or facilitates collection by a courier or freight carrier nominated by the Customer, including but not limited to FedEx, DHL, UPS and SF Express, the Seller's responsibility for the goods shall be fulfilled once the goods have been handed over to the relevant courier or carrier.

Upon such handover, the risk in the goods shall pass to the Customer, and the Seller shall not be responsible for any loss, damage, delay, misdelivery or other issue occurring during transportation, except to the extent caused by the Seller's own negligence or wilful misconduct.

3. Handover Evidence

 

The Seller may take and retain photographs, videos or other records of the goods at the time of packing and/or handover to the courier or carrier. Such records may be used as evidence of the quantity, condition and items handed over by the Seller.

 

4. Inspection and Discrepancies

 

The Customer shall inspect the goods promptly upon receipt. Any claim that the goods received are different from the items stated on the relevant invoice, including any alleged shortage, incorrect item, model, specification or quantity, must be notified to the Seller in writing within three (3) working days of delivery.

The Customer's notification shall include sufficient details of the alleged discrepancy and, where reasonably requested, photographs, videos, delivery records and other supporting evidence.

 

5. Failure to Notify

 

Subject to any rights that cannot lawfully be excluded or limited, if the Customer does not notify the Seller of an alleged discrepancy within the three (3) working-day period, the goods shall be deemed to have been received in accordance with the relevant invoice, and the Customer shall not subsequently reject the goods or withhold payment on the basis of an alleged discrepancy that should reasonably have been identified upon receipt.
